THE CRIMINAL LAW (AMENDMENT) ACT, 2013 AND THE INDIAN CRIMINAL JUSTICE SYSTEM: LEGAL TRANSFORMATION AND INSTITUTIONAL LIMITATIONS

Abstract

The Criminal Law (Amendment) Act, 2013 represented one of the most extensive reforms of Indian criminal law concerning sexual and gender-based violence. It expanded the definition of rape, introduced distinct offences of stalking, voyeurism, sexual harassment, disrobing and acid attack, restructured trafficking law, clarified the meaning of consent and strengthened procedural and evidentiary safeguards. More than a decade after its enactment, however, the impact of the legislation cannot be evaluated solely through the breadth of its provisions or the severity of punishment. This paper examines the effect of the amendment upon reporting, police investigation, medical examination, prosecution, trial, victim support and judicial interpretation. It uses doctrinal analysis together with official crime data and leading judicial decisions. The study finds that the amendment substantially improved the normative framework of sexual-offence law and increased the legal visibility of gender-based violence. Nevertheless, its practical operation remains constrained by uneven registration, weak forensic capacity, delays, victim intimidation, secondary victimisation and substantial differences in implementation among States and institutions. The paper concludes that the amendment was transformative in legal design but incomplete in institutional operation. Future reform should focus upon certainty of enforcement, scientific investigation, victim assistance, judicial capacity and accountability rather than relying predominantly upon increased punishment.
